Terms of Use

These terms are for use of the HappyNest website and consumer portal. They do not replace a brokerage agreement, agency disclosure, MLS agreement, privacy notice, or professional advice.

1. Acceptance and scope

These Terms of Use govern your access to the HappyNest Homes website, consumer portal, listing alerts, home-tracking tools, forms, and related services (the Services). By creating an account or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. The Services are informational

The Services provide general real-estate information, public listing information where available, communication tools, and organizational tools. Information may be incomplete, delayed, estimated, or changed without notice. Listing information is not a representation or warranty about a property. Home-value estimates are opinions or automated estimates, not appraisals, broker price opinions, guarantees, or promises of sale price.

3. No agency or professional advice by account creation

Creating an account, saving a home, requesting information, or communicating through the Services does not by itself create an agency, brokerage, fiduciary, buyer-representation, seller-representation, or other professional relationship. Real-estate, legal, tax, lending, insurance, inspection, appraisal, and other professional questions should be directed to the appropriate licensed or qualified professional. Any agency relationship or representation agreement must be established separately in writing where required.

4. Accounts and security

You must provide accurate information and keep your login credentials secure. You are responsible for activity under your account and must promptly notify us of unauthorized access. Do not create an account for another person, share access, or use another person's private portal information without permission. We may suspend or close accounts that create security, legal, operational, or consumer-protection risks.

5. Portal data and communications

The portal may organize saved homes, search alerts, home information, transactions, messages, and homeowner resources. Availability depends on data sources, approvals, provider systems, and your notification settings. You are responsible for reviewing important dates, documents, listing status, and other information with your agent or the relevant official source. Email and text alerts may be delayed or unavailable; message and data rates may apply to SMS, and you can manage notification preferences or use STOP where applicable.

6. MLS, listing, and third-party content

Some information comes from MLS, public-record, valuation, mapping, communication, or other third-party sources. Use of protected listing information may require registration, current terms, or other eligibility controls. The current terms for HappyNest's detailed listing search are available at /mls-vow-terms and must be reviewed and accepted when that feature is enabled. You may not scrape, republish, redistribute, sell, or use the Services or listing data to build a competing database. Third-party websites and services are governed by their own terms and policies.

7. Acceptable use

You may use the Services only for lawful personal real-estate and homeownership purposes. You may not interfere with the Services, probe or bypass security controls, submit malicious code, impersonate another person, send unauthorized messages, harvest personal information, infringe rights, or use the Services to discriminate, harass, defraud, or violate housing, privacy, communications, or other applicable laws.

8. Intellectual property and feedback

HappyNest Homes and its licensors retain rights in the Services, branding, software, editorial content, designs, and other materials except for content owned by you or third parties. You may use the Services only as permitted here. If you provide feedback, you allow us to use it to improve the Services without payment or confidentiality obligations, subject to applicable law.

9. Availability and disclaimers

The Services are provided on an as-available basis. To the extent permitted by law, HappyNest Homes disclaims warranties of accuracy, completeness, merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, and freedom from error. We do not guarantee a listing, alert, valuation, lender outcome, transaction result, closing, price, or response time.

10. Limitation of liability

To the extent permitted by law, HappyNest Homes and its owners, agents, employees, contractors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, opportunities, or goodwill, arising from use of or inability to use the Services. Nothing in these Terms limits liability that cannot legally be limited.

11. Changes and termination

We may update the Services or these Terms from time to time. The updated version will be posted with a revised effective date. We may suspend or terminate access when reasonably necessary. Provisions that by their nature should survive termination—including ownership, acceptable use, disclaimers, limitations, and dispute provisions—will survive.

12. Governing law and contact
